Terms and Conditions of Trading:
All orders are accepted on the following terms and conditions of trading.
If there should be any conflict between the terms and conditions of trading and the terms of your order, these terms prevail unless otherwise agreed with us in writing.
ACCEPTANCE We will send our invoice/acknowledgement on receipt of order. No order shall be deemed accepted by us other than upon receipt of this official acknowledgement. Upon receipt, all details in the invoice/acknowledgement should be checked and notification given to us immediately if anything is incorrect or missing as mistakes cannot be rectified once the item has been cast.
AFTER SALES To enable us to deal as quickly as possible with any after sale enquiries our invoice number shown on the invoice/acknowledgement should be quoted.
PAYMENT From the absence of any other written agreement between the parties, payment in full is due with orders. Our prices are quoted in British £ Sterling. We accept payment by credit/debit card or cheque.
DELIVERY Manufacture/Delivery time is given as accurately as possible but is not guaranteed and is subject to extension to cover delay caused by strikes, illness, lock-outs, works breakdowns, delay in transport, shortage of raw materials, Government regulations or requirements or any cause beyond our control.
PRICES We reserve the right to increase prices regardless of any price list existing at a given time. Prices will only be accepted as being firm upon issue of an official receipt of order from the Company.
DESCRIPTION All descriptions and particulars on this web site are given as accurately as possible but are provided for the purpose of general information only. We do not guarantee that customers’ orders will have the same size of lettering, layout, colour and artwork seen on our website, advertising literature or items on display unless this is specifically requested in writing at the time of order. Artists’ individual styles of painting vary, making each item unique. We will need a clear picture and/or colour sample when specific colours or markings are required. We endeavour to match these as closely as possible but, due to the paint limitations, we do not guarantee an exact match. All measurements shown or quoted are approximate and may vary slightly during casting.
GUARANTEE Goods will be accepted for return up to a period of six months if any defect due to faulty workmanship is found. This guarantee does not affect your statutory rights.
LIMITATION OF LIABILITY We accept no liability for any damage that may occur after delivery. This includes accidental damage, misuse, damage during fixing or the use of inappropriate cleaning materials. The installer is responsible for ensuring that appropriate and adequate fixings are used.
RETURN OF GOODS Our custom-made goods are exempt from the distance selling ‘cooling off period’ and therefore no returns will be accepted unless faulty. Initially, and before returning faulty goods, the customer should contact us to explain the nature of the problem. Arrangements will then be made with the customer for the return of the item. If, upon inspection, the goods are found to be defective due to faulty workmanship, a repair will be carried out or a replacement sent as soon as possible. We do not send temporary replacements. Goods damaged in transit, short or wrongly delivered must be notified to our sales office within three working days. We will require proof of damage to packaging together with an explanatory letter to enable the carrier to investigate. The customer shall be responsible for all costs, including postage & packing if the item is found not to be faulty due to workmanship or damage in transit.
RE-SENDING OF PARCELS We reserve the right to charge extra postage to cover the costs of re-sending parcels that have been returned to us due to incorrect or insufficient address details being given, change of address without sufficient notification, or due to non-collection by the customer from the depot after attempted delivery was made by the carrier. In such circumstances parcels will be re-sent only when the extra postage costs have been received.
NON-ARRIVAL OF GOODS If goods are not received by the latest estimated delivery time given on the invoice/acknowledgement, the customer should contact our sales office, quoting our order/invoice number. We do not investigate or give ‘up-dates’ on the stage of manufacture until after the latest estimated delivery time has expired.
PASSING OF PROPERTY Unless prior agreement has been given in writing, goods shall remain with the seller and shall not pass to the buyer until the full purchase price has been paid.
CHANGING OR CANCELLING AN ORDER A charge may be incurred for any changes made after the start of manufacture. Notification of any changes should be made as soon as possible and followed-up in writing. Changes made could involve delay in the manufacturing time and consequently the delivery time. As our items are personalised or custom-made, a ‘cooling off’ period does not apply and therefore can only be cancelled upon forfeit of the full amount payable.
